Copyright As Censorship: Newport Television Abusing DMCA To Try To Silence Criticism
The crux of Free Press' argument is that local TV stations are skirting media ownership rules by setting up joint operations with other channels to share costs. Basically, it allows operations to consolidate without technically being owned by the same operation. As an example, they pointed to Newport's WAWS-TV and WTEV-TV, which share services and have a consolidated news room. They included a screenshot of the two websites and logos briefly in a video discussing this. Free Press points to this video, but, for the life of me, I can't see either station mentioned or their logos anywhere.
Either way, showing a screenshot and a log in such cases is clearly not a copyright violation at all. But Newport Television not only sent a bogus cease-and-desist (embedded below) to Free Press, but also issued a bogus DMCA takedown to YouTube, who took down the video. Free Press, of course, is not one to back down and has filed a counternotice and responded sternly to Newport Television, which has just called a lot more attention to its news sharing practices, whether you think they're a good idea or a bad idea.
This is a clear case of Newport Television abusing copyright law and the DMCA, in particular, to stifle and censor critical commentary. Even if you disagree with Free Press on this issue (as I do), I at least believe they have the right to be heard. In fact, if anything, Newport Television's actions here make me more sympathetic to Free Press' position here than I would be otherwise.

Because, Congress here in the US is currently debating two bills that seem to do exactly that as well. There's the data retention bill (disguised as an anti-child porn bill) and there's the PROTECT IP Act, which would give the government power to require ISPs to effectively block web sites. It's as if Congress doesn't even realize what it's doing and what it's saying.

iPhoto, GarageBand & iMovie updated in Mac App Store (Updated)

A brief moment of confusion overtook us this morning as we got reports of new versions of GarageBand (6.0.4), iMovie (9.0.4) and iPhoto (9.1.5), with minor bug fixes plus tweaks to iMovie's ability to import projects from the iOS editions of the app.
When several of us fired up Software Update to grab the new builds, the updates were nowhere to be seen -- yet our tipster was insistent that the new updates were there. Our friends at MacUpdate also had them listed... and that's where we figured out the mystery. So far, only the Mac App Store versions of the apps have been revised; the conventionally-installed iLife versions have not yet been released.
While we're sure the 'classic' updates will be forthcoming momentarily, this split-update did give us a moment's pause. As far as we can recall, this is the first time any of Apple's products have been available in newer versions on the MAS than via Software Update. Times, they are a-changin'.

Worth investing in the stream of notifications as we remodel our graphs one more time. Without the aggregation of citations, Plus is more an interactive manual for itself than anything disruptive. Google has the time and motivation to get everyone in their seats before starting the game, and we're comfortable enough waiting while we check our old familiar streams to see what we're missing. How Apple Led The High-Stakes Patent Poker Win Against Google, Sealing Ballmer?s Promise
"It's not like Android's free. Android has a patent fee. You do have to license patents." That was Microsoft CEO Steve Ballmer in an interview last year with The Wall Street Journal. At the time, Microsoft was on the verge of releasing their first Windows Phone 7 devices, and knew their best hope in the market would be to go after Android ? the same OS which quickly ran Windows Mobile into extinction. In the months that have followed, right or wrong, it looks like Microsoft is slowly but surely forcing Google's OEM partners for Android to agree with this stance. The reality is that for an increasing number of these partners now, Android is not free. It doesn't require the�licensing�fees that Windows Phone does, but it does require a patent fee. A fee paid to Microsoft, not Google, mind you. If Microsoft is able to convince (or force) Samsung to pay this fee as well, it's likely lights out for Android as a free OS, as Tom Krazit rightly points out on paidContent today. And with Microsoft and now HP offering their own rival mobile OSes backed by a vast array of patent protection, some of these OEM partners may begin to think twice about their firm Android commitments. At least, that's undoubtedly Microsoft's hope. Android as a free mobile OS that rivals iOS in terms of functionality is an�unbelievable�value proposition. Modern community building
The Stack Exchange network is already up to 51 sites on diverse topics, from math to cooking to science fiction. Each site is a community on its own, and each community has its own needs and values. Pouring a big fat algorithm in equal measures on top of 51 different groups of people does not always work the way you might hope it would work. Maybe that?s why the super-algorithm companies (like Google) tend to suck when they try to build social applications.
Our goal as a company is to incubate each of these 51 communities?to get them to critical mass. Critical mass is that magic moment when the community has enough activity that it grows by itself.
Building communities on the Internet is a new kind of profession. There are an awful lot of technology companies, founded by programmers, who think they are building communities on the Internet, but they?re really just building software and wondering why the community doesn?t magically show up.
Stack Exchange is trying really hard not to suck at building communities. I would say we?re earning a solid B so far, but we?re working really hard at learning... doing little experiments and getting early results. And one thing we noticed is that the pure, algorithmic approach can?t possibly work for different communities: you need a political/social approach. That is, you need smart human beings to use smart human judgment and cultivate each community individually.
Or, to use a metaphor that has been on my mind, you can?t use a robot to train a puppy. Every puppy is different.
With 51 communities and a new one opening almost every week, our small team of four community managers are doing a great job but they just don?t have the bandwidth to help cultivate every site. So we depend on the most active, enthusiastic users to promote their own communities and help them flourish. But these users are usually domain experts, not community organization experts.
So what I plan to do is build a team of super-evangelists here at Stack Exchange to serve as backup. Sort of like Lady Gaga?s backup dancers, but probably without as many muscles, they are not onstage to lead; they?re there to fill up the stage with more hotness than one person can provide.
This job will be sort of like being a community organizer at a non-profit. It combines elements of marketing, PR, and sales, but it?s really something different. I don?t expect that there are a lot of people out there who already kn0w how to do this well, so I?m going to train them, personally. Not that I know how to do this, but we?ll learn together. Every workday is going to start with a huddle at 9am and a plan for the day?s activities and an intensive six hours of work. Every workday is going to end with an hour of learning... reading Kawasaki and Godin and Ries and Trout, talking with invited experts, meeting with members of the community about what worked and what didn?t worked. Everyone who joins the program (and survives for a year) will come out with an almost supernatural ability to take a dead, lifeless site on the internet and make it into the hottest bar in town. That?s a skill worth learning for the 21st century.

MobileMe webmail balks at political bulk mailings

Unfortunately, as originally reported by John Brownlee at Cult of Mac, it looks like Apple may be filtering out emails sent from the online MobileMe client based on content. The story is that a user was trying to send an email mentioning "Authoritarian Oppressive Regimes," and when sent, those messages would not go through to their intended recipients, with no error message back from Apple. Cult of Mac sent a few more test messages through the system, and found that simpler emails with less political messages made it through just fine.
There's a few things to note here: First, this is the web client only -- there's no indication that any emails sent via MobileMe's SMTP/IMAP interface are being blocked in this way. Second, Apple has replied to the CoM story to say that certain messages caught by spam filters may be blocked from sending through the web client, but that "Apple is not blocking MobileMe email due to political content." Anyone having a problem sending anything through MobileMe is encouraged to contact MobileMe support.
Perhaps most importantly, when Apple's rep was asked why no error message was given, there was no further comment. That's perhaps the biggest problem here -- Apple can do what it wants with its own service (even if that's to block messages based on political content, as unlikely as that actually is, a private service can do it), but Apple should at least notify users when messages are being blocked.
You could argue that Apple is trying to discourage mass email spammers from abusing the MobileMe system, and because of that doesn't want to clue spammers in on which message can and can't go through. That's a legitimate concern, but even so, if non-spammer customers are being blocked, there needs to be some way for them to be informed about the issue so it can be fixed.
